We may update this Privacy Notice from time to time. If we make material changes to this Privacy Notice, we will post our updated Privacy Notice to the Site where applicable, and for a reasonable period of time we will post notice of the change so it is visible to visitors and users after the change is posted. It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us, for example, a new address or email address. By your continued use of the Site and/or Services, you will be deemed to consent to the terms of the revised Privacy Notice.
In order to provide the Site and our Services, we collect various types of information as described in this section. We collect personal information on our own behalf, and we collect personal information on behalf of our Customers in order to fulfill our Services. The following sections explain how we collect personal information, the types of information we collect, and our role as a service provider when processing information on behalf of Customers.
The personal information that we collect on our own behalf falls into the following categories:
· Personal Information You Provide to Us. We collect personal information directly from you when you provide it to us, such as when you contact us for more information about our Services or apply for a job.
· Personal Information We Collect Indirectly. We also may collect information indirectly through automated technologies, such as cookies, or from third parties who assist us with our business operations.
· Customer Information We Collect on Behalf of Our Customers. We may collect personal information from third parties, such as when a Customer submits a property address as explained below in the section titled “Customer Information We Collect on Behalf of Our Customers”.
We collect personal information that Site visitors and Customers provide voluntarily through the Site, for example when you contact us via online forms or use our Services, as described in more detail below.
If you contact us via our dedicated web form, you may be asked for your:

· Company Name
· Project Information
· Other information that we may request
· Phone Number
If you visit our Site, you may apply for a job with us. In doing so, you may provide personal information including your name, email address, phone number, information in your resume or CV, information in your cover letter, information from your LinkedIn profile and other information that you submit to us in relation to your job application.
When Customers sign up to use our Services, we will request the following personal information for each authorized user under a Customer account:
· Name
· Email Address and Username
· Password
When you visit the Site, we automatically collect certain technical information about your device and how you interact with the Site through cookies and similar technologies, as explained below. This may include your:
· IP address
· Device type
· Operating system version
· Browser type and language
· Referring and exit pages, and URLs
· Number of clicks on a web page
· Amount of time spent on a web page
· Domain names
· Landing pages
· Pages viewed and the order of those pages
We use this information to operate the Site, understand visitor behavior, improve our Services, and for analytics, marketing, and advertising purposes.
We use cookies (small files stored on your device) and similar technologies such as web beacons and pixels. These include session cookies (deleted when you close your browser) and persistent cookies (which remain until deleted). Some cookies are first-party cookies – meaning our cookies. We also use third-party cookies – meaning cookies from a domain different than ours – for our advertising and marketing efforts. These cookies are necessary for the Site to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in, or filling in forms. These cookies enable the Site to provide enhanced functionality and personalization. They may be set up by us or by third party providers whose services we have added to our pages, for instance our email communications providers or video functions. We may engage partners who assist us with marketing our Site and Services. Some of the partners will use information obtained from cookies – such as your device identifier, device fingerprint, or IP address – to serve you targeted marketing about the Services. · Remarketing Tags
We use remarketing services to show advertisements to previous Site visitors on third-party platforms. Third-party vendors use cookies to serve ads based on your past Site activity, subject to their respective privacy policies.
The Site uses analytics cookies and similar technologies provided by third-party analytics services to collect and store information about your device and use of the Site. These analytics tools help us understand how visitors interact with the Site, including calculating visitor traffic, session duration, and the effectiveness of our marketing campaigns. Under applicable data protection laws, including the General Data Protection Regulation (GDPR) and the ePrivacy Directive, we are required to obtain your consent before placing non-essential cookies on your device. Essential cookies that are strictly necessary for the Site to function do not require consent and cannot be disabled. Zesty.ai is a service provider or “Processor” with respect to the Services, and as such processes personal information only in accordance with our Customer’s instructions.
When you engage Zesty.ai to provide the Services, we collect and use information that is necessary for the performance of those Services. When Customers use our Services, Customer users will submit property addresses to us. Note that we do not collect the names or other personal information regarding property owners or individuals associated with a particular property address. Our third party service providers may provide us with the geolocation of the property address.
Customers are responsible for ensuring that they have the authority and/or consent of their clients to provide us with their property address.
We only use this information to provide our Services. The information that our Customers provide about their clients is only disclosed to third party service providers in order to provide our Services. We do not use any Customer client personal information for any other purpose than to provide our Services to Customers.
If you are a client of one of our Customers and would like to know your options with respect to the personal information that we process, please contact the Customer directly.
We will use your personal information for the purposes below. The applicable legal bases for these activities are described in the Legal Basis for Processing section.
· Provide the Site and Services — Legal basis: performance of a contract with you; and, where necessary to operate and secure the Site, our legitimate interests.
· Communicate with individuals who contact us via the Site contact form — Legal basis: our legitimate interests in responding to inquiries and, where applicable, taking steps at your request before entering into a contract.
· Respond to and fulfill your requests for Services or other inquiries — Legal basis: performance of a contract with you or, where no contract exists, our legitimate interests in responding to and fulfilling your request.
· Contact you in connection with any of our Services and transactions on our Services — Legal basis: performance of a contract with you and, where necessary, our legitimate interests in administering our relationship.
· Contact you for marketing purposes — Legal basis: your consent where required by law, or our legitimate interests in carrying out direct marketing and targeted advertising where permitted by law; you may opt out at any time.
· Contact you for job positions for which you apply — Legal basis: our legitimate interests in evaluating applications and taking steps at your request before entering into an employment contract.
· Understand how you use the Site and perform research and analytics — Legal basis: our legitimate interests in analyzing and improving the Site and Services; consent where required for non-essential analytics cookies.
· Enhance user experience and customize, personalize and deliver content that you see on the Site, including for marketing and advertising purposes (such as on social media) — Legal basis: our legitimate interests in improving the Site, personalizing content and developing our business; consent where required for non-essential cookies or targeted advertising.
· Enforce our user agreements and other contractual rights and protect our rights and property and the rights and property of others — Legal basis: our legitimate interests in protecting rights, property and users and enforcing agreements; and legal obligation where required by law.
· Enable feedback — Legal basis: our legitimate interests in receiving and evaluating feedback; consent where required for a voluntary survey or similar activity.
· Comply with the law — Legal basis: legal obligation where processing is necessary to comply with applicable law.
Data protection law requires us to have a legal basis for collecting and using your personal information. We rely on one or more of the following legal bases, depending on the purpose and circumstances of the processing:
· Performance of a contract: We may use your personal information where it is necessary to perform a contract we are about to enter into or have entered into with you, including providing the Site and Services.
· Legitimate interests: We may use your personal information where necessary to conduct our business and pursue our legitimate interests, such as improving and securing the Site, preventing fraud, responding to inquiries, enforcing agreements, and conducting direct marketing where permitted. Alternatively, we may sell businesses or business units, merge with other entities and/or sell assets or stock, in some cases as part of a reorganization or liquidation in bankruptcy, as well as raise capital through financings. In connection with, in contemplating, or as part of, these transactions, we may transfer your personal information to another entity upon a merger, consolidation, financing or other corporate reorganization in which Zesty.ai participates, or to a purchaser or acquirer of all or a portion of Zesty.ai’s assets, bankruptcy sale included.

· To fulfill the purpose for which you provide it.
· For any other purpose disclosed by us when you provide the information.

We may also disclose your personal information:
· To comply with the law or in response to a valid subpoena, court order, government request, or other valid legal process;
· To produce relevant documents or information in connection with litigation, arbitration, mediation, adjudication, government, or internal investigations, or other legal or administrative proceedings;
· To protect the interests, rights, safety, or property of Zesty.ai or others; or
· To enforce the user agreement terms or other contractual obligations.
This section describes the choices you can make about how we collect and use your information, as well as your legal rights under applicable data protection laws. Your rights may vary depending on where you are located.
You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Services to collect information through other tracking technologies by clicking the “Do Not Sell or Share My Personal Information” link here and following the instructions. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly.
Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target audience preferences, you can opt out by clicking the “Do Not Sell or Share My Personal Information” link.
Some browsers have incorporated “Do Not Track” (DNT features that can send a signal to the websites you visit indicating you do not wish to be tracked. We do not currently respond to browser DNT signals. However, we do recognize Global Privacy Control (”GPC”) signals. When we detect a GPC signal from your browser, we will treat that signal as a valid request to opt out of the sale or sharing of personal information associated with that browser.
You may opt out at any time of receiving direct marketing emails and other promotional email communications. You may opt-out by choosing the “Unsubscribe” option available as a link in every promotional email. You may also do so by contacting us at hello@zesty.ai.
We will gladly comply with all requests to opt-out of or unsubscribe from promotional communications but reserve the maximum amount of time allowed by law to process such requests. You cannot opt-out of certain transactional emails or communications, which are necessary to conclude a transaction or provide the Services.
The Site and Services are not intended for children. We do not knowingly collect personal information relating to children or knowingly market to children. If you are under 18, you are not permitted to submit any personal information to us or on the Site.
If you are a parent or guardian and believe that we have the personal information of your minor child in our database, please contact us immediately at hello@zesty.ai to request that we remove such information from our records.
We have implemented technical and organizational measures designed to protect against the loss, misuse, and alteration of your personal information. Despite our efforts, however, no security measures are perfect or impenetrable. We appreciate your help in safeguarding the integrity of your own and others’ privacy and encourage you to let us know immediately if you suspect that any personal information you shared with us is being used contrary to this Privacy Notice. We have procedures to deal with suspected personal information breaches and will notify you and any applicable regulator of a breach where we are legally required to do so.
We will retain the personal information that we collect where we have an ongoing legitimate business need to do so, including to provide you with our Services, or to comply with applicable legal, tax, or accounting requirements. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it. If this is not immediately possible because your personal information has been stored in backup archives, we will securely store your personal information and isolate it from any further processing until deletion is possible.
Under applicable data protection laws, you may have the following rights in relation to your personal information. These rights may be subject to conditions or exceptions under applicable law.
· Right to request access: You may request access to your personal information, commonly known as a subject access request. This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
· Right to request correction: You may request correction of the personal information we hold about you, including correction of incomplete or inaccurate information.
· Right to request erasure/deletion: You may request that we delete or remove your personal information in certain circumstances, including where there is no good reason for us to continue processing it or where applicable law requires erasure. We may not always be able to comply for specific legal reasons, which we will explain if applicable.
· Right to object: You may object to processing of your personal information where we rely on legitimate interests, including profiling based on those interests. You have an absolute right to object at any time to processing for direct marketing purposes, including profiling related to direct marketing.
· Right to request restriction: You may ask us to suspend processing of your personal information, including while we verify its accuracy, where processing is unlawful but you do not want erasure, where you need the information for legal claims, or while we assess an objection based on alleged overriding legitimate grounds.
· Right to data portability: You may request transfer of your personal information to you or a third party in a structured, commonly used, machine-readable format where the applicable legal requirements are met.
· Right to withdraw consent: Where we rely on consent to process your personal information, you may withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out before withdrawal, and may mean that we cannot provide certain products or Services.

No fee usually required. You will not usually have to pay a fee to exercise these rights. However, we may charge a reasonable fee or refuse to act on a request if it is clearly unfounded, repetitive, or excessive.
Time limit to respond. We will respond to legitimate requests within one month. If a request is particularly complex or you have made a number of requests, we may take longer, but we will notify you and keep you updated as required by law.
We do not use your personal information for decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you. If this changes, we will update this Privacy Notice and, where required by law, provide you with meaningful information about the logic involved, the significance, and the envisaged consequences of such processing.
We are located in the United States, and the personal information that we collect may be stored on servers located in the United States or transferred to and processed in other countries outside the UK or European Economic Area. These countries may have data protection laws that are different from, and in some cases less protective than, the laws of your country or region.
Where we transfer personal information outside the UK or European Economic Area, we will do so only where an adequacy decision applies or where appropriate safeguards are in place. These safeguards may include the UK International Data Transfer Agreement, the International Data Transfer Addendum to the European Commission’s Standard Contractual Clauses, the EU Standard Contractual Clauses where applicable, or binding corporate rules, together with enforceable rights and effective legal remedies.

We do not sell your personal information within the scope of, and according to the defined meaning of a “sale” under, Nevada Revised Statutes Chapter 603A.
